This disclaimer governs your use of all artificial intelligence features, diagnostic suggestions, treatment recommendations, and clinical decision support functionalities offered through TCM Clinical Pro (the "Platform"), operated by TCM Clinical Pro Ltd., registered in Portugal (the "Company"). By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by this disclaimer.

The Platform is a clinical decision support tool (CDST) designed exclusively for use by licensed and qualified healthcare professionals, including but not limited to acupuncturists, Traditional Chinese Medicine (TCM) practitioners, herbalists, and integrative medicine doctors. It is not intended for use by, or directed at, patients or the general public. The Platform uses artificial intelligence (AI), including large language models and pattern recognition systems, to assist practitioners in generating differential diagnoses, treatment protocol suggestions, herbal formula recommendations, and clinical reasoning support. All AI-generated outputs are intended solely as professional reference material and not as definitive clinical conclusions.

Nothing on the Platform constitutes medical advice, diagnosis, or treatment as defined under the laws of any jurisdiction. The AI-generated outputs, pattern identifications, acupuncture point selections, herbal formula suggestions, and any other content produced by the Platform are informational tools for qualified professionals and must be independently verified by the practitioner before application to any patient case. The Company does not practise medicine, acupuncture, or any regulated healthcare profession, and the Platform is not a substitute for the professional judgment, clinical examination, or expertise of a licensed practitioner.

AI systems, including those used by the Platform, have inherent limitations: • AI outputs may contain errors, omissions, or clinically inappropriate suggestions. • AI pattern recognition is probabilistic, not deterministic, and may produce different outputs for similar clinical inputs. • The AI does not conduct physical examination and cannot replace the four TCM diagnostic pillars (望闻问切) as performed by a trained practitioner. • AI-generated herbal formulas must be reviewed against current pharmacopoeia standards, patient-specific contraindications, and applicable jurisdiction regulations before dispensing. • The Platform's accuracy rates are based on aggregate pattern-matching against training data and do not guarantee accuracy in any individual clinical case. Practitioners are solely responsible for the clinical decisions they make, including any decision to adopt, modify, or reject AI-generated recommendations.

By using the Platform, you acknowledge and agree that: • You are a licensed and qualified healthcare professional authorised to practise in your jurisdiction. • You retain full professional and legal responsibility for all clinical decisions, diagnoses, and treatment plans. • You will independently verify all AI-generated outputs before applying them to patient care. • You will maintain appropriate professional indemnity insurance for your practice. • You will comply with all applicable laws, professional codes of conduct, and regulatory requirements in your jurisdiction. • You will not use the Platform's outputs as the sole basis for clinical decisions without independent professional assessment.

Herbal medicine involves complex interactions that require professional expertise. The AI-generated herbal formula suggestions: • Are based on classical TCM literature and are not a substitute for pharmacological expertise. • May not account for all known herb-drug interactions, individual patient contraindications, or jurisdictional restrictions on specific herbs. • Must be reviewed by a qualified herbalist or practitioner before dispensing. • The built-in safety analysis tool is an assistive aid only and does not guarantee identification of all contraindications. Practitioners dispensing herbal medicines are solely responsible for compliance with applicable pharmaceutical regulations.

The Platform is a clinical decision support software (CDSS). It is not classified as a medical device under EU MDR 2017/745, FDA 21 CFR Part 820, or equivalent regulations in other jurisdictions. The AI features are assistive tools for qualified professionals and do not constitute autonomous diagnostic or treatment systems. Practitioners operating in regulated healthcare environments should verify the Platform's compliance status with their applicable regulatory framework before use.

To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from: • Reliance on AI-generated diagnoses, treatment recommendations, or herbal formulas. • Clinical outcomes resulting from the use or misuse of Platform outputs. • Errors, omissions, or inaccuracies in AI-generated content. • Any adverse patient outcome connected directly or indirectly to the use of the Platform. The Company's aggregate liability shall not exceed the subscription fees paid by the User in the three months preceding the claim.

The Company reserves the right to update this disclaimer at any time. Continued use of the Platform following notification of changes constitutes acceptance of the updated disclaimer. Practitioners are advised to review this disclaimer periodically.
